    To Triangl Customer Service, I am writing to raise a complaint regarding the MALA – Banc Blue Balconette Bikini Set. After just over a year of normal use, the underwire in the balconette top has broken through the fabric casing and is now poking into my skin (see attached photos). I want to be clear about what I am and am not claiming here. I understand that the consumer guarantees under the Australian Consumer Law (ACL) do not cover ordinary wear and tear, and I would not expect Triangl to stand behind, for example, general fading, minor fraying at the edges, or loose threads from normal wear. That is not what has happened here. What has occurred is that a structural component of the garment - the underwire - has broken free of its casing entirely. This is not surface wear; it is a failure of the garment's construction and durability. Under section 54 of the ACL, goods must be of acceptable quality, meaning they must be, among other things, safe, durable, and free from defects, to the standard a reasonable consumer would regard as acceptable given the nature of the goods and their price. A bikini top whose underwire fails and pokes through the fabric within around a year of normal wear does not meet that standard, and it also raises a safety issue, since a garment worn against the skin should not have a hard plastic component protruding from it. Because the fault relates to safety and durability rather than cosmetic wear, I am requesting either a replacement of the same style or the option to chose a new style.
